These Terms & Conditions ("Terms") apply when you visit this website or place an order with SaminaZ Collections ("we", "us", "our"), operating from Edmonton, Alberta, Canada. By using the site or ordering, you agree to these Terms. Please read them together with our Privacy Policy, Shipping Policy, Refund & Return Policy and Cookie Policy.

Business details: SaminaZ Collections is a trade name of a sole proprietorship owned and operated by Samina Naz, registered with Alberta Corporate Registry and based in Edmonton, Alberta, Canada, trading since 2008. Contact details are on our Contact page.

1. Who May Order

You must be at least the age of majority in your province or territory (18 in Alberta) to place an order, or have the consent of a parent or guardian. You agree that the information you give us — especially your delivery address, phone number and email — is accurate and complete.

2. Your Account

An account is optional; you can check out as a guest. If you create one, you are responsible for keeping your password confidential and for activity under your account. Tell us right away if you believe your account has been used without permission. We may suspend or close an account that is used for fraud, abuse, or in breach of these Terms.

3. Products, Colours and Sizing

• We describe every item as accurately as we can, including fabric and measurements.
• Colour can appear different between screens, and can vary slightly between production batches of the same fabric. Small variation is normal and is not a defect.
• Hand-worked details such as embroidery, beadwork and sequins are made by hand, so small irregularities are part of the craft.
• Please use the measurements on the product page and our Size & Care Guide before ordering. If you are between sizes, message us — we are glad to help.
• Stock is limited and can sell out while an item is in your cart. Availability is confirmed when we accept your order.

4. Prices and Taxes

• All prices are in Canadian dollars (CAD).
• Applicable Canadian sales taxes (GST/HST, and provincial tax where it applies) are calculated and shown at checkout before you pay.
• Shipping is calculated at checkout based on your destination — see our Shipping Policy.
• Prices, promotions and free-shipping thresholds may change at any time, but changes never affect an order we have already accepted.
• Pricing errors: if an item is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it.

5. Orders and Acceptance

Your order is an offer to buy. Placing an order and receiving an automatic confirmation does not mean we have accepted it — the contract forms when we confirm the order is being prepared or ship it. We may decline or cancel an order (and refund any payment in full) if:

• the item is out of stock or no longer available;
• there was a pricing or description error;
• we cannot verify your payment, or we suspect fraud or unauthorised card use;
• the delivery address is outside the areas we ship to, or cannot be delivered to.

You can ask us to change or cancel an order before it ships and we will do our best to accommodate you — see the Refund & Return Policy.

6. Payment

• Card payments (Visa, Mastercard, American Express and other supported cards) are processed securely by Stripe. We never receive your full card number.
• Any additional payment methods we offer — for example Interac e-Transfer or payment on local pickup — are shown at checkout. If you use one of these, please include your order or invoice number as the reference so we can match your payment.
• Orders are prepared once payment is confirmed. Unpaid orders may be cancelled.

7. Shipping and Delivery

Delivery times, areas, fees and tracking are set out in our Shipping Policy, which forms part of these Terms. Estimated delivery times are estimates, not guarantees; we are not responsible for delays caused by carriers, customs, weather or other events outside our control, but we will always help you locate a parcel.

For orders shipped to the United States, any duties, import taxes or customs fees are the customer's responsibility.

8. Made-to-Order and Custom Items

Some items are made or altered to order. Because they are produced for you specifically, they cannot be cancelled once production has started and are not eligible for return unless faulty. The product page will tell you when an item is made to order.

9. Returns and Refunds

Our Refund & Return Policy explains when and how you can return an item — in summary, unused items in original condition may be returned within 14 days of delivery, and damaged, defective or incorrect items should be reported within 48 hours of delivery with photos. That policy forms part of these Terms.

10. Reviews and Content You Submit

If you submit a review, photo or other content, you confirm it is your own honest experience and does not infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to publish, display and use it to promote the store, with your first name or display name. We may decline or remove content that is false, offensive, unlawful, spam, or unrelated to the product. Reviews may require a signed-in account so we can keep them genuine.

11. Acceptable Use

You agree not to misuse the site — including attempting to gain unauthorised access, interfering with its operation or security, scraping or copying the site or its content for commercial use, submitting false orders, or using it to break the law.

12. Intellectual Property

The SaminaZ Collections name, logo, site design, text, and our own product photography are our property or used with permission, and may not be copied or used commercially without our written consent.

13. Limitation of Liability

We provide the site and products with reasonable care. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for the item(s) concerned, and we are not liable for indirect, incidental or consequential losses.

Nothing in these Terms limits any right you have that cannot be limited by law — including your rights under Alberta's Consumer Protection Act and other applicable Canadian consumer-protection legislation.

14. Events Outside Our Control

We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including carrier disruption, extreme weather, strikes, supplier failure, power or internet outages, or government action.

15. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Disputes will be handled by the courts of Alberta, unless consumer-protection law entitles you to bring a claim where you live.

16. Changes to These Terms

We may update these Terms from time to time. The version that applies to your order is the one published when you placed it. The "Last updated" date below shows the current version.
